When is an image, graphic, text, etc. pro\u00adtected by copy\u00adright?\u201d. In this arti\u00adcle, you can read which cri\u00adte\u00adria must be met for the level of cre\u00adation and what the low\u00adest limit for the level of cre\u00adation is. <\/p>\n\n<h2 class=\"wp-block-heading\">Criteria for the level of creation<\/h2>\n\n<p>Sec\u00adtion 2 (2) of the Copy\u00adright Act refers to so-called \u201cper\u00adsonal intel\u00adlec\u00adtual cre\u00adations\u201d. A work ful\u00adfills these cri\u00adte\u00adria if it:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>has a per\u00adcep\u00adti\u00adble form (e.g. music, writ\u00ading, film, image, chore\u00adog\u00adra\u00adphy),<\/li>\n\n\n\n<li>is a per\u00adsonal cre\u00adation (not exclu\u00adsively cre\u00adated by machi\u00adnes\u00b9),<\/li>\n\n\n\n<li>has an intel\u00adlec\u00adtual con\u00adtent (miss\u00ading in the case of pure crafts\u00adman\u00adship) and<\/li>\n\n\n\n<li>has indi\u00advid\u00adu\u00adal\u00adity (pecu\u00adliar\u00adity, orig\u00adi\u00adnal\u00adity)<br><\/li>\n<\/ul>\n\n<p><em>\u00b9Nowa\u00addays, entire works of art, nov\u00adels etc. are cre\u00adated exclu\u00adsively by arti\u00adfi\u00adcial intel\u00adli\u00adgence. Against the back\u00adground of the clear reg\u00adu\u00adla\u00adtion in Sec\u00adtion 2 (2) UrhG, the ques\u00adtion of author\u00adship of such works arises. This means that there is no clear def\u00adi\u00adn\u00adi\u00adtion of the level of cre\u00adation. Rather, it is up to the courts to inter\u00adpret the term on a case-by-case basis.  <\/p>\n\n<p>The term \u201ccre\u00adation\u201d is gen\u00ader\u00adally asso\u00adci\u00adated with a cre\u00adative process that has a cer\u00adtain level of design, a qual\u00adity con\u00adtent (see Thoms, Der urhe\u00adber\u00adrechtliche Schutz der kleinen M\u00fcnze, 1980, 246 ff.). One usu\u00adally only speaks of a cre\u00adation if some\u00adthing unprece\u00addented is cre\u00adated (Schulze\/Dreier\/Schultze, 6th edi\u00adtion, \u00a7 2 para. 16). The work must be dis\u00adtin\u00adguish\u00adable from pre\u00advi\u00adously exist\u00ading works and must also be spe\u00adcial. This very sub\u00adjec\u00adtive approach becomes some\u00adwhat more objec\u00adtive when cer\u00adtain indi\u00adca\u00adtions are taken into account. For exam\u00adple, the judg\u00adment of the respec\u00adtive pro\u00adfes\u00adsional com\u00admu\u00adnity, the suc\u00adcess of the work (e.g. a piece of music), the com\u00adplex\u00adity (e.g. in the case of com\u00adputer pro\u00adgrams), the first impres\u00adsion of the work, its unique\u00adness, etc. can speak for the pro\u00adtectabil\u00adity of a work.    <\/p>\n\n<p>In con\u00adtrast, the effort, costs, time invested and the qual\u00adity and quan\u00adtity of a work play no role in the assess\u00adment of the level of cre\u00adation.<\/p>\n\n<h2 class=\"wp-block-heading\">The lowest limit of the level of creation<\/h2>\n\n<p>It is gen\u00ader\u00adally rec\u00adog\u00adnized that works of art, music and lan\u00adguage are pro\u00adtected by copy\u00adright law as so-called \u201csmall coins\u201d. The small coin deter\u00admines the low\u00adest limit of works that can still be pro\u00adtected by copy\u00adright. Such works have lit\u00adtle indi\u00advid\u00adu\u00adal\u00adity and stand out only slightly from the every\u00adday, the ordi\u00adnary, the banal (e.g. sim\u00adple recipe col\u00adlec\u00adtions, jin\u00adgles, sim\u00adple com\u00adputer pro\u00adgrams).  <\/p>\n\n<h2 class=\"wp-block-heading\">Rule of thumb<\/h2>\n\n<p>Assume that the work you are using is sub\u00adject to copy\u00adright and do not use it with\u00adout the per\u00admis\u00adsion of the copy\u00adright holder, unless it is obvi\u00adously some\u00adthing very sim\u00adple and triv\u00adial.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cri\u00adte\u00adria for the level of cre\u00adation Sec\u00adtion 2 (2) of the Copy\u00adright Act refers to so-called \u201cper\u00adsonal intel\u00adlec\u00adtual cre\u00adations\u201d.
