Our blog post \u201c<a href=\"https:\/\/www.twillo.de\/en\/blog\/citing-correctly-in-teaching-citation-rights-explained-in-an-understandable-waymusic-in-musical-works\/\">Cit\u00ading cor\u00adrectly in teach\u00ading: An under\u00adstand\u00adable expla\u00adna\u00adtion of cita\u00adtion rights<\/a>\u201d also con\u00adtains gen\u00aderal expla\u00adna\u00adtions of cita\u00adtion rights. <\/p>\n\n<h2 class=\"wp-block-heading\">Screencasts and Screenshots<\/h2>\n\n<p>Legally, a screen\u00adshot or screen\u00adcast is a repro\u00adduc\u00adtion of third-party con\u00adtent (web\u00adsite, soft\u00adware inter\u00adface, video, social media post, etc.). A per\u00admis\u00adsi\u00adble quo\u00adta\u00adtion only exists if <\/p>\n\n<ul class=\"wp-block-list\">\n<li>the recorded pro\u00adgram interface\/other media con\u00adtent itself is the sub\u00adject of the expla\u00adna\u00adtion (e.g., if the con\u00adtent is ana\u00adlyzed, func\u00adtion\u00adal\u00adi\u00adties are dis\u00adcussed in detail, menus or oper\u00adat\u00ading logic are com\u00adpared or dis\u00adcussed in detail, etc.),<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>the screenshot\/screencast directly aids under\u00adstand\u00ading of one\u2019s own expla\u00adna\u00adtions (inter\u00adnal con\u00adnec\u00adtion),<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>only as much is shown as nec\u00ades\u00adsary, i.e., only excerpts rel\u00ade\u00advant to the dis\u00adcus\u00adsion,<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>the pro\u00adgram and cre\u00adators of the con\u00adtent are fully cred\u00adited (source ref\u00ader\u00adence in the video\/material).<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>Not per\u00admit\u00adted as a quo\u00adta\u00adtion: Screen\u00adcasts that show copy\u00adrighted films, series, news\u00adpa\u00adper arti\u00adcles, games, pro\u00adgrams, or entire web\u00adsites solely to \u201cdemon\u00adstrate what it looks like\u201d with\u00adout dis\u00adcussing the con\u00adtent.<\/p>\n\n<h2 class=\"wp-block-heading\">musical quotations<\/h2>\n\n<p>Music can also be quoted \u2013 <a href=\"https:\/\/www.gesetze-im-internet.de\/urhg\/__51.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Sec\u00adtion 51 of the Ger\u00adman Copy\u00adright Act (UrhG)<\/a> does not dis\u00adtin\u00adguish between dif\u00adfer\u00adent types of works; the con\u00adtext is what mat\u00adters.<\/p>\n\n<h3 class=\"wp-block-heading\">Music in musical works<\/h3>\n\n<p>In musi\u00adcal works, i.e., com\u00adpo\u00adsi\u00adtions, arrange\u00adments, or remixes, the use of musi\u00adcal quo\u00adta\u00adtions is sub\u00adject to par\u00adtic\u00adu\u00adlarly strict reg\u00adu\u00adla\u00adtions because even short sequences of notes can make a work clearly rec\u00adog\u00adniz\u00adable. Sec\u00adtion 51(3) of the Ger\u00adman Copy\u00adright Act (UrhG) there\u00adfore expressly per\u00admits only the quo\u00adta\u00adtion of \u201cindi\u00advid\u00adual pas\u00adsages from a pub\u00adlished musi\u00adcal work\u201d in another musi\u00adcal work\u2014and even then only under strict con\u00addi\u00adtions. Only short, clearly defined excerpts, typ\u00adi\u00adcally short motifs or dis\u00adtinc\u00adtive pas\u00adsages, are per\u00admit\u00adted to be embed\u00added in a new musi\u00adcal work. <\/p>\n\n<p>As with a \u201cnor\u00admal\u201d quo\u00adta\u00adtion, there must be a pur\u00adpose for the quo\u00adta\u00adtion: the motif must be used in a mean\u00ading\u00adful way in terms of con\u00adtent, for exam\u00adple as an allu\u00adsion, homage, par\u00ado\u00addic device, or delib\u00ader\u00adate styl\u00adis\u00adtic quo\u00adta\u00adtion. The quoted excerpt must remain rec\u00adog\u00adniz\u00adable as a for\u00adeign ele\u00adment and must not carry or dom\u00adi\u00adnate the new work. For exam\u00adple, it would be per\u00admis\u00adsi\u00adble to quote the open\u00ading motif of Beethoven\u2019s 5th Sym\u00adphony as a homage to an oth\u00ader\u00adwise inde\u00adpen\u00addent com\u00adpo\u00adsi\u00adtion.<\/p>\n\n<h3 class=\"wp-block-heading\">Music in teaching and learning materials<\/h3>\n\n<p>Edu\u00adca\u00adtional resources such as scripts, lec\u00adture slides, audio com\u00admen\u00adtaries, or video lec\u00adtures are gen\u00ader\u00adally pro\u00adtected by copy\u00adright as lit\u00ader\u00adary works or hybrid forms com\u00adbin\u00ading text, images, and sound. The gen\u00aderal require\u00adments for quo\u00adta\u00adtions set out in Sec\u00adtion 51 of the Ger\u00adman Copy\u00adright Act (UrhG) there\u00adfore apply to any music included in such resources. <\/p>\n\n<p><strong>The fol\u00adlow\u00ading are per\u00admit\u00adted in par\u00adtic\u00adu\u00adlar:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>a short record\u00ading of a piece of music to explain or ana\u00adlyze style, har\u00admony, lyrics, struc\u00adture, or pro\u00adduc\u00adtion meth\u00adods in a tar\u00adgeted man\u00adner;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>The use of audio exam\u00adples that are com\u00admented on in direct rela\u00adtion to the topic at hand, for exam\u00adple, dur\u00ading a detailed dis\u00adcus\u00adsion of a pop song in a music or media sem\u00adi\u00adnar.<\/li>\n<\/ul>\n\n<p><br><strong>The fol\u00adlow\u00ading, in par\u00adtic\u00adu\u00adlar, are not cov\u00adered by the right to quote:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Com\u00adpo\u00adsi\u00adtions as mere back\u00adground music in edu\u00adca\u00adtional videos, with\u00adout any inde\u00adpen\u00addent exam\u00adi\u00adna\u00adtion of con\u00adtent<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>the com\u00adplete repro\u00adduc\u00adtion of a song with\u00adout a com\u00adpre\u00adhen\u00adsi\u00adble pur\u00adpose of quo\u00adta\u00adtion;<\/li>\n<\/ul>\n\n<p><br><strong>For OER, this means:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Short musi\u00adcal quo\u00adta\u00adtions with a rec\u00adog\u00adniz\u00adable pur\u00adpose can be part of open teach\u00ading mate\u00adri\u00adals as long as they are rec\u00adog\u00adniz\u00adable as quo\u00adta\u00adtions.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>OER should not be designed in such a way that a song or sub\u00adstan\u00adtial parts thereof are effec\u00adtively avail\u00adable as freely acces\u00adsi\u00adble audio con\u00adtent, thereby replac\u00ading reg\u00adu\u00adlar forms of use (stream\u00ading, pur\u00adchase, licens\u00ading); in such cases, the lim\u00adits of fair use would be exceeded.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Texts<\/h2>\n\n<p>When quot\u00ading text, care must be taken to ensure that the scope and weight of the exter\u00adnal text does not become exces\u00adsive: your own work must clearly be in the fore\u00adground in terms of both con\u00adtent and scope, and the quo\u00adta\u00adtion may only have a sup\u00adport\u00ading func\u00adtion. The exter\u00adnal work may there\u00adfore not form the core of your own pre\u00adsen\u00adta\u00adtion or replace your own thoughts, but may only serve as evi\u00addence for your own argu\u00admen\u00adta\u00adtion. <\/p>\n\n<p>The per\u00admis\u00adsi\u00adble scope depends on the pur\u00adpose of the quo\u00adta\u00adtion and must be deter\u00admined on a case-by-case basis; as a guide\u00adline, text quo\u00adta\u00adtions should gen\u00ader\u00adally only com\u00adprise an excerpt and, as a rule, only a frac\u00adtion of the third-party work. Entire lin\u00adguis\u00adtic works (e.g., a com\u00adplete arti\u00adcle or a com\u00adplete poem) may only be quoted in full in excep\u00adtional cases if the con\u00adtent must be dis\u00adcussed in rela\u00adtion to the com\u00adplete text and a shorter pas\u00adsage would not serve the pur\u00adpose of analy\u00adsis or dis\u00adcus\u00adsion (typ\u00adi\u00adcal, for exam\u00adple, in the case of short poems). <\/p>\n\n<p><strong>Typ\u00adi\u00adcally required are:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Author: First and last name<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Title of work (arti\u00adcle or book title)<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>In antholo\u00adgies: if applic\u00ada\u00adble, title of the journal\/series or anthol\u00adogy<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Year of pub\u00adli\u00adca\u00adtion<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Page number(s) of the cited pas\u00adsage<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>For online texts, also include: URL and, if pos\u00adsi\u00adble, (last) date accessed.<\/li>\n<\/ul>\n\n<p><em>Exam\u00adple:<br>M\u00fcller, Anna (2026): \u201cTitle of the essay,\u201d in: Jour\u00adnal X, 12, pp. 45\u201347.<\/em><\/p>\n\n<h2 class=\"wp-block-heading\">Pictures and illustrations<\/h2>\n\n<p>Illustrations\u2014such as graph\u00adics, pho\u00adtos, or dia\u00adgrams from spe\u00adcial\u00adist jour\u00adnals and textbooks\u2014may also be quoted under the con\u00addi\u00adtions set out in Sec\u00adtion 51 of the Ger\u00adman Copy\u00adright Act (UrhG). Pub\u00adlish\u00aders may not \u201cpre\u00advent\u201d such law\u00adful quo\u00adta\u00adtions; the right to quote is a manda\u00adtory copy\u00adright restric\u00adtion and can\u00adnot be effec\u00adtively excluded by gen\u00aderal terms and con\u00addi\u00adtions or license pro\u00advi\u00adsions. <\/p>\n\n<p><strong>An image cita\u00adtion is per\u00admis\u00adsi\u00adble<\/strong> if the image in ques\u00adtion is itself the sub\u00adject of the dis\u00adcus\u00adsion, for exam\u00adple:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the analy\u00adsis of a dia\u00adgram or sta\u00adtis\u00adtics,<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>the inter\u00adpre\u00adta\u00adtion of a car\u00adtoon or illus\u00adtra\u00adtion,<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>the art-his\u00adtor\u00adi\u00adcal dis\u00adcus\u00adsion of a paint\u00ading, pho\u00adto\u00adgraph, or poster.<\/li>\n<\/ul>\n\n<p>In these cases, the image serves as a nec\u00ades\u00adsary point of ref\u00ader\u00adence for analy\u00adsis, crit\u00adi\u00adcism, com\u00adpar\u00adi\u00adson, or inter\u00adpre\u00adta\u00adtion; with\u00adout the image cita\u00adtion, the argu\u00adment itself would be dif\u00adfi\u00adcult or impos\u00adsi\u00adble to under\u00adstand.<\/p>\n\n<p>How\u00adever, the purely dec\u00ado\u00adra\u00adtive use of images <strong>is not cov\u00adered by the right to quote<\/strong>, for exam\u00adple:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>any photo on the title slide just because it \u201clooks nicer,\u201d<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>an illus\u00adtra\u00adtion to lighten the mood, with\u00adout going into detail<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>An image that is only used as a back\u00adground graphic, for exam\u00adple.<\/li>\n<\/ul>\n\n<p>In such cases, the image is interchangeable\u2014it could be replaced by any other com\u00adpa\u00adra\u00adble illus\u00adtra\u00adtion with\u00adout chang\u00ading the con\u00adtent or mes\u00adsage of the text. In this case, the nec\u00ades\u00adsary inter\u00adnal con\u00adnec\u00adtion between the work and the quo\u00adta\u00adtion is miss\u00ading; this is nor\u00admal use, not a quo\u00adta\u00adtion. <\/p>\n\n<p>Images may be quoted in part or in full, pro\u00advided that the scope is jus\u00adti\u00adfied by the pur\u00adpose of the quo\u00adta\u00adtion:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>If an excerpt (e.g., a detail from a map or dia\u00adgram) is suf\u00adfi\u00adcient, only that part should be used.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>If the image can only be mean\u00ading\u00adfully ana\u00adlyzed as a whole (e.g., a car\u00adi\u00adca\u00adture or a work of art whose mes\u00adsage is derived from the over\u00adall com\u00adpo\u00adsi\u00adtion), a full quo\u00adta\u00adtion may be per\u00admis\u00adsi\u00adble.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p><strong>For image cita\u00adtions, the source ref\u00ader\u00adence should include:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Author: First and last name<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Title of the image (or a descrip\u00adtion if no title exists)<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Year of ori\u00adgin (if known)<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Ref\u00ader\u00adence:<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>For repro\u00adduc\u00adtions in books: addi\u00adtion\u00adally, book title, pub\u00adlisher, year of pub\u00adli\u00adca\u00adtion, page num\u00adber.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>For museum works: museum\/collection and loca\u00adtion.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>For online images: URL and date accessed.<\/li>\n<\/ul>\n\n<p><em>Exam\u00adple:<br>Image: van Gogh, Vin\u00adcent: Starry Night, 1889, Museum of Mod\u00adern Art, New York.<br>Photo: Max Exam\u00adple, \u201cTitle of photo,\u201d in: Meier, Sabine: Land\u00adscapes, Berlin: Exam\u00adple Pub\u00adlish\u00ading, 2023, p. 12.<\/em><\/p>\n\n<h2 class=\"wp-block-heading\">Movies and videos<\/h2>\n\n<p>The same basic prin\u00adci\u00adples apply to film and video quo\u00adta\u00adtions as to text or image quo\u00adta\u00adtions, but they are han\u00addled par\u00adtic\u00adu\u00adlarly restric\u00adtively due to the typ\u00adi\u00adcal length and appeal of audio\u00advi\u00adsual works.<\/p>\n\n<p>The use of film excerpts is per\u00admit\u00adted if they are specif\u00adi\u00adcally ana\u00adlyzed or com\u00admented on in terms of con\u00adtent and sub\u00adject mat\u00adter, for exam\u00adple in the con\u00adtext of film analy\u00adsis or media crit\u00adi\u00adcism. The excerpt must be nec\u00ades\u00adsary for the respec\u00adtive dis\u00adcus\u00adsion and must be embed\u00added in a sep\u00ada\u00adrate work; it may not serve merely as illus\u00adtra\u00adtion or \u201clight relief.\u201d <\/p>\n\n<p>How\u00adever, inte\u00adgrat\u00ading entire films or longer videos into OER or pub\u00adlicly acces\u00adsi\u00adble teach\u00ading mate\u00adri\u00adals is not con\u00adsid\u00adered quo\u00adta\u00adtion, but rather reg\u00adu\u00adlar use of the work\u2014this requires usage rights or licenses. The lim\u00adi\u00adta\u00adtion of quo\u00adta\u00adtion rights does not legit\u00adimize com\u00adplete repro\u00adduc\u00adtion in this case, as the OER mate\u00adr\u00adial would oth\u00ader\u00adwise effec\u00adtively become a free sub\u00adsti\u00adtute source for the film. <\/p>\n\n<p>In excep\u00adtional cases, short films or videos may be quoted in full if the require\u00adments for exten\u00adsive sci\u00aden\u00adtific quo\u00adta\u00adtions under Sec\u00adtion 51, sen\u00adtence 2, no. 1 of the Ger\u00adman Copy\u00adright Act (UrhG) are met. This requires that: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>an inde\u00adpen\u00addent sci\u00aden\u00adtific work (e.g., essay, dis\u00adser\u00adta\u00adtion, research report, lec\u00adture),<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>eine ver\u00adtiefte inhaltliche Auseinan\u00adder\u00adset\u00adzung ger\u00adade mit diesem konkreten Film\/Video,<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>the need to repro\u00adduce the work in its entirety because the pur\u00adpose of the analy\u00adsis or dis\u00adcus\u00adsion can only be mean\u00ading\u00adfully achieved on the basis of the entire short film (e.g., in the case of very short videos or com\u00admer\u00adcials),<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>a clear dom\u00adi\u00adnance of one\u2019s own expla\u00adna\u00adtions over mere repro\u00adduc\u00adtion, as well as<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>A com\u00adplete cita\u00adtion (direc\u00adtor, title, year, pro\u00adduc\u00adtion com\u00adpany, source\/URL, time details).<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p><strong>For film and video quo\u00adta\u00adtions, the fol\u00adlow\u00ading is rec\u00adom\u00admended as a min\u00adi\u00admum:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Name of the direc\u00adtor (and pro\u00adducer, if applic\u00ada\u00adble)<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Title of the film\/video<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>year of pro\u00adduc\u00adtion<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Pro\u00adduc\u00adtion loca\u00adtion and pro\u00adduc\u00adtion com\u00adpany (or plat\u00adform)<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Exact time stamp of the quoted sequence (e.g., 00:01:10\u201300:01:25)<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>For online videos, also include: URL and date accessed.<\/li>\n<\/ul>\n\n<p><em>Exam\u00adple:<br>Zemeckis, Robert (direc\u00adtor): For\u00adrest Gump [film], USA: Para\u00admount Pic\u00adtures, 1994, 01:02:14\u201301:02:45.<\/em><\/p>\n\n<h2 class=\"wp-block-heading\">AI-generated content<\/h2>\n\n<p>It is impor\u00adtant to dis\u00adtin\u00adguish here: The right to quote is a lim\u00adi\u00adta\u00adtion of copy\u00adright law and requires that the quoted mate\u00adr\u00adial is pro\u00adtected by copy\u00adright as a work or part of a work.<br>Accord\u00ading to cur\u00adrent opin\u00adion, purely machine-gen\u00ader\u00adated AI con\u00adtent is gen\u00ader\u00adally not con\u00adsid\u00adered to be the \u201cper\u00adsonal intel\u00adlec\u00adtual cre\u00adation\u201d of a human being and is there\u00adfore often not pro\u00adtected by copy\u00adright (de facto in the pub\u00adlic domain). Such pub\u00adlic domain con\u00adtent may be used, mod\u00adi\u00adfied, and repro\u00adduced to any extent with\u00adout the right to quote; legally, this is not a \u201cquo\u00adta\u00adtion\u201d but free use.<\/p>\n\n<p>Nev\u00ader\u00adthe\u00adless, the right to quote can play a role in AI mate\u00adr\u00adial:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Human-influ\u00adenced AI out\u00adput<\/strong>: If AI is only used as a tool and the result is edited to such an extent that it becomes a \u201cper\u00adsonal intel\u00adlec\u00adtual cre\u00adation,\u201d the result may again be pro\u00adtected as a work.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>AI out\u00adput con\u00adtains parts of third-party works<\/strong>: AI out\u00adput that rec\u00adog\u00adniz\u00adably incor\u00adpo\u00adrates pas\u00adsages, images, or music from pro\u00adtected works (e.g., almost orig\u00adi\u00adnal song lyrics, strik\u00ading book pas\u00adsages, typ\u00adi\u00adcal images) is prob\u00adlem\u00adatic.<br>These parts remain pro\u00adtected by copy\u00adright; any\u00adone who uses them either needs per\u00admis\u00adsion or can rely on the right to quote in the case of analy\u00adsis, crit\u00adi\u00adcism, etc.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>The <strong>clear label\u00ading of AI out\u00adput<\/strong> is strongly rec\u00adom\u00admended in prac\u00adtice.
